- Marijuana-derived CBD oil:
- Contains more than 0.3% THC
- Classified as a Schedule 1 controlled substance
- Not federally legalized for either medical or recreational use
Under their new ‘special instructions’, however, TSA is finally recognizing this difference. If you’re flying with CBD oil that is hemp-derived, you’re good to go!
But if you’re flying with CBD oil that is marijuana-derived, there is a risk of getting in legal trouble – even if medical marijuana is legal in your state.
Enforcing the New CBD Standard with TSA
Now that there is a TSA approved CBD oil, how will TSA agents go about enforcing it? Will they be trained in distinguishing between hemp-derived and marijuana-derived CBD?
That’s a question we can’t answer. Though TSA claims that flying with CBD oil from hemp is legal to fly with, there is no actual procedure in place for them to be confident that the product in your carry-on is TSA approved CBD oil.
Yet when talking cannabis, the TSA isn’t actively seeking out marijuana products. On their webpage, TSA claims that their focus is on security and threats regarding carrying illicit products. Essentially, they aren’t there to confiscate cannabis just for the hell of it.
But in no way are we advocating for flying with CBD that is marijuana-derived – we’re actually doing the opposite. TSA goes on to explain how if they discover an illegal substance in your belongings, they have to report it to local law enforcement.
The takeaway? When flying with CBD oil, stick to hemp-derived products. They’re federally legal, TSA approved, and won’t make you step aside for further inspection and potentially late for your plane.
Flying Abroad with CBD Oil
Jetting off to a tropical island? Exploring ancient ruins? Unfortunately, we don’t advise bringing your CBD along abroad – even if it’s hemp-derived. That’s right, flying with CBD oil outside of the United States can get tricky.

But that doesn’t mean that flying with CBD oil, even if its hemp-derived, is as simple as flying with perfume, toothpaste, or shaving cream. Here are some tips for CBD air travelers when preparing for their flight:
- What kind of CBD product are you bringing?
- Flying with CBD tinctures, lotions, or sprays? Liquids, including CBD oils, must follow the TSA container volume rule of 3.4oz or less.

- The label might read “hemp-derived” or “THC-free”, but that doesn’t mean the lab results do! Review your product’s lab report to make sure what you’re traveling with is legal.

- CBD oil products must be handled with care. Keep them in your carry-on or personal item – no one wants cracked or broken CBD!
